Container Ease Terms and Conditions
1. Introduction
Welcome to Container Ease (“Container Ease”, “we”, “us”, or “our”). These Terms and Conditions (“Terms”) govern your use of our containerized ocean freight transportation services (“Services”). By using our Services, you (“Shipper”, “you”, or “your”) agree to be bound by these Terms.
2. Cargo Acceptance and Limitations
2.1 Restricted Cargo: We reserve the right to refuse transport of any Cargo deemed unsafe, illegal, perishable, or unsuitable for containerized shipping. Please refer to our prohibited items list for details.
2.2 Packing and Labeling: You are responsible for ensuring your Cargo is properly packed, labeled according to international regulations, and secured to withstand ocean travel.
2.3 Accurate Information: You warrant that all information provided regarding the Cargo, including weight, dimensions, and content description, is accurate and complete. Discrepancies may result in delays and additional charges.
3. Shipper’s Responsibilities
3.1 Documentation: You are responsible for obtaining all necessary licenses, permits, and documentation for the import and export of your Cargo.
3.2 Customs Clearance: You are responsible for arranging for customs clearance at both origin and destination ports. Any delays or charges related to customs issues are your responsibility.
3.3 Duties and Taxes: You are responsible for all duties, taxes, and other charges associated with the Cargo payable to the relevant authorities.
4. Container Ease Liability
4.1 International Conventions: Our liability for loss or damage to your Cargo is subject to international conventions governing carriage by sea, such as the Hague-Visby Rules, unless otherwise agreed upon in writing.
4.2 Limitation of Liability: We are not liable for any indirect, consequential, or incidental damages arising from the transportation of your Cargo.
5. Delays
5.1 Commercially Reasonable Efforts: We will use commercially reasonable efforts to transport your Cargo on schedule. However, we are not liable for delays caused by factors beyond our control, including:
- Weather conditions
- Mechanical failures
- Labor disputes
- Acts of God (e.g., natural disasters)
- Government restrictions
5.2 Communication: We will keep you informed of any delays impacting your shipment to the best of our ability.
6. Payment
6.1 Full Payment Required: You are responsible for full payment of all freight charges, terminal fees, and other associated costs before the Cargo is released at the destination port.
6.2 Payment Methods: We accept various payment methods as listed on our website. Late payments may be subject to interest charges and/or storage fees.
7. Indemnification
You agree to indemnify, defend, and hold Container Ease harmless from and against any and all claims, liabilities, losses, damages, costs, and expenses (including attorney fees) arising out of or related to:
- Your breach of these Terms.
- Any act or omission related to the Cargo, including customs issues or violations of law.
8. Termination
Container Ease may terminate these Terms at any time, with or without cause, and may refuse to provide Services to you in the future.
